Terms & Conditions.

These Terms and Conditions were last updated in June of 2025.

These Terms and Conditions (collectively, the “Terms”), together with our Privacy Policy, form a legally binding agreement between you (“You” or “Your”) and The Mason Projects LLC, a New Jersey limited liability company that operates under the brand names FBI Jane and Janexfbi (collectively referred to as “The Mason Projects,” “We,” “Our,” or “Us”). All references to “The Mason Projects” in these Terms include The Mason Projects LLC and its affiliated brands, FBI Jane and Janexfbi.

We ask that you carefully review these Terms and Conditions—including the dispute resolution provisions, opt-out link, Fair Credit Reporting Act (FCRA) notice, and other use restrictions—before using, accessing, posting on, or purchasing any product or service from The Mason Projects; janexfbi.com; fbijane.com; any FBI Jane mobile application; or any other affiliated website, service, or mobile platform that links to or incorporates these Terms (collectively, the “Site”).

By accessing or using the Site, or by making any purchase through it, you confirm your full acceptance of these Terms. If you do not agree to these Terms, please do not use the Site, provide any information through it, or make any purchases.

1. Notice Regarding the Fair Credit Reporting Act (FCRA) and Related Use Restrictions

The Mason Projects LLC, including its affiliated brands FBI Jane and Janexfbi (collectively referred to as “The Mason Projects”), provides access to databases containing publicly available sources of information. This information is aggregated and presented for your personal, individual use—such as learning what is in the public record about an online date or other social contact—not for professional, employment-related, or commercial evaluation purposes.

Through the Site, end users may request access to certain types of content (“Content”) compiled, distributed, or displayed by The Mason Projects and third-party content providers (“Third-Party Providers”). This may include information about individuals (“Search Subjects”) that is available via third-party websites, services, or public records and may be requested through the Site (“Search Requests”).

The Mason Projects is not a consumer reporting agency as defined by the Fair Credit Reporting Act, 15 U.S.C. § 1681 et seq. (“FCRA”). The information and Content provided by The Mason Projects—whether through FBI Jane, Janexfbi, or any other part of the Site—is not collected or supplied, in whole or in part, for the purpose of serving as a factor in determining a person’s eligibility for:

  • Credit or insurance to be used primarily for personal, family, or household purposes;

  • Employment, including hiring, reassignment, promotion, or retention;

  • Educational admissions or benefits;

  • Tenancy or leasing decisions; or

  • Any business transaction initiated by an individual consumer for personal, family, or household purposes.

We do not make any representation or warranty regarding a person’s creditworthiness, credit standing, credit capacity, character, general reputation, personal characteristics, or lifestyle. The consumer protections and legal obligations that apply to consumer reporting agencies under the FCRA do not apply to our services.

Accordingly, by using the Site, you agree that you will not request, obtain, or use any Content or other information from The Mason Projects about a Search Subject for any purpose prohibited by the FCRA. Specifically, you may not use any such information:

  • To evaluate a Search Subject for employment, including household work such as childcare, cleaning, or contract labor;

  • To assess eligibility for leasing a residence or commercial space;

  • To make decisions regarding educational admission, financial aid, or scholarship eligibility;

  • To determine personal creditworthiness, loan risk, or insurance eligibility;

  • To evaluate a consumer’s ongoing eligibility in a personal business transaction.

You also may not use any Content to take an “adverse action” as that term is defined under the FCRA.

Using information from The Mason Projects in any of the above ways violates both these Terms and federal law and may subject you to civil or criminal liability. We reserve the right to terminate access and report violations to law enforcement or other relevant authorities where appropriate.

If you are unsure whether your intended use complies with these restrictions, please contact us at jane@fbijane.com before submitting any Search Request or obtaining information about any Search Subject.

2. Scope of These Terms, License Grant, Electronic Signature, and Legal Age Requirement

These Terms govern your access to and use of the Site, including any Content provided by The Mason Projects, your purchase of membership plans or services, and your use of any information or materials obtained through the Site, including Search Requests.

By using the Site, you expressly accept and agree to be bound by all of the Terms outlined herein. If you do not agree with these Terms in their entirety, you are not authorized to access or use the Site or its Content, and you must exit the Site immediately.

You also agree that:

  • When you complete a purchase, select a method of payment, and provide your payment information, you authorize The Mason Projects to charge the designated payment method and associated account for any selected product, service, or membership plan;

  • By engaging in any activity on the Site—including accessing pages (other than the homepage at www.masonprojectsllc.com), submitting an online form, or using services made available through the Site—you affirm that you (a) have read, understand, and accept these Terms in full; (b) consent to the use of electronic signatures, contracts, orders, and records, and to the electronic delivery of notices, policies, and transaction records; and (c) waive any rights under laws requiring non-electronic records, original signatures, or non-digital delivery methods.

These Terms apply to any use of the Site, including when you:

  • Access, view, download, or interact with any page or function beyond the home page;

  • Submit a form or application to become a user, client, or subscriber of services offered by The Mason Projects (including through the brands FBI Jane and Janexfbi); or

  • Use any features, searches, or Content made available to you as a user, including FBI Jane Queries or similar tools.

You must be at least eighteen (18) years of age and legally capable of entering into binding contracts under applicable law to access or use the Site or its services. If you are under 18, or if you do not agree to these Terms, you may not access, view, or use any part of the Site except for the public homepage.

The Mason Projects reserves the right, in its sole discretion and without notice, to deny access to the Site or any part of it, or to terminate your rights under these Terms at any time. Your rights under these Terms will terminate automatically if you violate any provision herein. Upon termination, you must immediately cease all use of the Site and destroy any copies of Content or materials obtained from the Site that are in your possession, custody, or control.

By providing your email address or otherwise engaging with the Site, you agree to receive communications from us electronically. The Privacy Policy of The Mason Projects is incorporated into these Terms by reference. By accepting these Terms, you acknowledge and agree to the collection and use of certain personally identifiable information as described in our Privacy Policy.

3.  Class Action Waiver, Mandatory Arbitration, Dispute Resolution and Governing Law

BY USE OF THE SITE, YOU ACKNOWLEDGE AND AGREE TO OUR MANDATORY ARBITRATION OF DISPUTES PROVISION THAT GENERALLY REQUIRES THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, RATHER THAN JURY TRIALS OR CLASS ACTIONS, AND ALSO LIMITS THE REMEDIES AVAILABLE TO YOU IN THE EVENT OF A DISPUTE. You acknowledge and agree that all claims, disputes or controversies between You and Us (including against any of Our employees, agents, affiliates, subsidiaries, predecessors, successors or assigns) relating to the Site or related websites, the Content, FBIJane Queries, related services and materials, any related transaction, product, or relationship and/or Your information, including, without limitation, tort and contract claims, claims based upon any federal, state or local statute, law, order, ordinance or regulation, the issue of arbitrability, shall be resolved by the final and binding arbitration procedures set below. You further acknowledge and agree that any such claims shall be brought solely in Your individual capacity and not as a plaintiff or class member in any purported class, representative proceeding, or private attorney general capacity. Similarly, you agree that any controversy concerning whether a dispute is arbitrable shall be determined by the arbitrator and not by a court and the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding. You voluntarily and knowingly waive any right to a jury trial.

BY AGREEING TO THIS AGREEMENT TO ARBITRATE, YOU ACKNOWLEDGE THAT YOU ARE GIVING UP YOUR RIGHT TO GO TO COURT AND YOUR RIGHT TO A JURY TRIAL. In arbitration, disputes are resolved by neutral arbitrators, rather than by a judge or jury. Arbitration is more informal than a court trial, however, an arbitrator can award relief.

Separate and apart from the agreement to arbitrate set forth above, You hereby waive any right to bring or participate in any class action in any way related to, or arising from, these Terms or the matters that they describe. You acknowledge that this class action waiver is material and essential to the arbitration of any dispute(s) You may have and is non-severable from this agreement to arbitrate claims.

YOU UNDERSTAND THAT BY AGREEING TO THIS AGREEMENT TO ARBITRATE, WHICH CONTAINS THIS CLASS ACTION LITIGATION AND CLASS ARBITRATION WAIVER, YOU MAY ONLY BRING CLAIMS AGAINST US, OUR AGENTS, OFFICERS, SHAREHOLDERS, MEMBERS, EMPLOYEES, SUBSIDIARIES, AFFILIATES, PREDECESSORS IN INTEREST, SUCCESSORS AND/OR ASSIGNS IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION OR REPRESENTATIVE PROCEEDING. IF YOU DO NOT AGREE TO THIS ARBITRATION AGREEMENT AND CLASS ACTION WAIVER, YOU MUST TELL US IN WRITING AND NOT USE OUR SITE, FBIJane QUERIES OR OUR SERVICES.

These Terms shall be treated as though they were executed and performed in the State of New Jersey and shall be governed by and construed in accordance with the laws of the State of New Jersey (without regard to conflict of law principles).

At FBIJane, We expect that Our customer service team will be able to resolve most complaints You may have regarding Our provision, or Your use of, our Site and its services, such as FBIJane Queries. If You have a complaint, You can contact Our customer service team at team@janexfbi.com. In the unlikely event that Your complaint remains unresolved, We prefer to specify now what each of us should expect in order to avoid any confusion later. Accordingly, You and FBIJane agree to the following resolution process for all disputes and claims that You or FBIJane may have arising from Our provision, or Your use, of our Site and its services, such as FBIJane Queries (each a "Service Claim").

In an attempt to find the quickest and most efficient resolution of any Service Claim, You and FBIJane agree to first discuss the Service Claim informally for at least 30 days. To do that, the party who brings the Service Claim must first send to the other party a notice that must include (1) a description of the Service Claim and (2) a proposed resolution. If You want to raise a Service Claim, You must send the aforementioned description and proposed resolution by email to team@janexfbi.com and/or certified mail to: FBIJane, Attn: Legal Department, 900 SE Central Ave., #223, Seaside Park, NJ 08752. To subsequently discuss Your Service Claim with You, We will contact You using the email address or mailing address You provide in Your communication to Us. If FBIJane wants to raise a Service Claim, We will send You the aforementioned description and claim notice to You at the email address that We have on file for You. If We do not have an email address for You on file, FBIJane will send Our Service Claim to You through a means that complies with the service of process rules of the State of New Jersey.

IF YOU AND FBIJane DO NOT REACH AN AGREED UPON RESOLUTION WITHIN 30 DAYS OF RECEIPT OF THE SERVICE CLAIM, YOU AND FBIJane AGREE THAT THE SERVICE CLAIM MUST BE RESOLVED THROUGH BINDING INDIVIDUAL (NOT CLASS) ARBITRATION WITH A WIDELY-RECOGNIZED ARBITRATION ORGANIZATION THAT IS MUTUALLY AGREEABLE TO THE PARTIES, IF POSSIBLE UNDER ANY RULES BY SUCH ORGANIZATION APPLICABLE TO DISPUTES BETWEEN BUSINESS AND CONSUMERS, BUT NEITHER PARTY SHALL UNREASONABLY WITHHOLD THEIR CONSENT.

EXCEPTIONS TO THIS ARBITRATION REQUIREMENT: EITHER PARTY HAS THE RIGHT TO PURSUE: AN INTELLECTUAL PROPERTY CLAIM OR CLAIM RELATING TO UNAUTHORIZED ACCESS TO DATA THROUGH THE SITE (INCLUDING, BUT NOT LIMITED TO, CLAIMS RELATING TO PATENT, COPYRIGHT, TRADEMARK, SERVICE MARK AND TRADE SECRETS AND CLAIMS RELATING TO THE ACCESS OR RETRIEVAL OF DATA THROUGH THE SITE USING AN AUTOMATED PROCESS SUCH AS SCRAPING) IN STATE OR FEDERAL COURTS LOCATED IN THE STATE OF NEW JERSEY. BOTH FBIJane AND YOU AGREE TO SUBMIT TO THE PERSONAL JURISDICTION OF THOSE COURTS FOR THESE CLAIMS.

NOTHING HEREIN SHALL BE CONSTRUED TO PRECLUDE ANY PARTY FROM SEEKING INJUNCTIVE RELIEF IN THE STATE OR FEDERAL COURTS LOCATED IN NEW JERSEY IN ORDER TO PROTECT ITS RIGHTS PENDING AN OUTCOME IN ARBITRATION. TO HELP RESOLVE ANY ISSUES BETWEEN US PROMPTLY AND DIRECTLY, YOU AND FBIJane AGREE TO BEGIN ANY ARBITRATION OR COURT PROCEEDINGS ALLOWED UNDER THIS SECTION WITHIN ONE YEAR AFTER A CLAIM ARISES AND AGREE TO WAIVE THE RIGHT TO TRIAL BY JURY; OTHERWISE, THE CLAIM IS WAIVED.

This is a Class Action and Trial Waiver. IT IS IMPORTANT THAT YOU UNDERSTAND THAT BY ENTERING INTO THESE TERMS, YOU ARE WAIVING THE RIGHT TO PARTICIPATE IN A CLASS ACTION AGAINST US. THE ARBITRATOR'S DECISION OR AWARD WILL BE CONCLUSIVE AND BINDING AND MAY BE ENTERED AS A JUDGMENT IN ANY COURT OF COMPETENT JURISDICTION.

4. Restrictions on Your Use of the Site and Information Obtained from The Mason Projects — Your Obligations

As a condition of submitting a Search Request, accessing any Content, or receiving an Investigative Report, you agree that, unless expressly authorized in writing by The Mason Projects, you will not engage in any of the following activities:

I. Prohibited Uses Under the FCRA and Related Laws

Because The Mason Projects is not a consumer reporting agency, you are strictly prohibited from using any Investigative Search, Investigative Report, or any Content obtained through the Site as a factor in determining a Search Subject’s eligibility for:

  • Employment (including household roles such as babysitters, cleaning personnel, contractors, or domestic workers);

  • Tenancy or lease decisions (residential or commercial);

  • Educational admissions, financial aid, or program qualifications;

  • Personal credit, loans, or insurance (including assessing creditworthiness or debt obligations);

  • Any business transaction initiated by an individual consumer (including evaluating ongoing account eligibility);

  • Adoption (human, animal, or service animal-related placements or entrustments);

  • Participation in nonprofit, charitable, or community-based programs.

Use of any information from the Site for these or similar purposes may violate the Fair Credit Reporting Act (FCRA), these Terms, and other applicable laws, and may result in criminal penalties. The Mason Projects takes misuse seriously and reserves the right to terminate access, suspend accounts, and report violations to law enforcement.
If you are unsure whether your intended use is permitted, please contact us in advance through our contact form at FBIJane.com/contact. We will get back to you as soon as possible.

  7. Create derivative works based on the Site, Content, or Investigative Reports, or use such material in connection with third-party platforms.

  8. Engage in any conduct that, in The Mason Projects’ sole discretion, places an excessive burden on Site infrastructure or suggests prohibited, bulk, or automated use patterns.

  9. Obfuscate or forge IP addresses, use VPNs to conceal origin, or otherwise disguise your identity when submitting a Search Request or accessing the Site.

  10. Deep-link to internal pages, simulate ("frame" or "mirror") the Site, or otherwise replicate its appearance or functions elsewhere online.

E. Monitor usage patterns and subscriber activity for signs of professional or unauthorized use. We reserve the right to audit, limit, suspend, or deactivate accounts as needed to ensure compliance. You may be contacted by our team to verify that your use is consistent with these Terms and applicable law.

If a promotional price or discount applies to your order, it will be displayed on the checkout page before purchase. If you believe that you have been billed in error, please contact our customer support team at FBIJane.com/contact as soon as possible. We will investigate and work to resolve any billing issues promptly.

7. Proprietary Rights

All proprietary rights in and to the Site and its Content—including the design, structure, organization, coordination, and presentation of Search Requests, Investigative Searches, Investigative Reports, and all other materials—are owned by The Mason Projects LLC and are protected by copyright, trademark, and other intellectual property laws.

You are not granted any rights, licenses, or permissions to use any part of the Site or its Content except as expressly provided in these Terms or through prior written authorization. This includes, but is not limited to, all patents, copyrights, trade secrets, service marks, trademarks, and publicity rights.

Use of the Site does not transfer any ownership interest to you. All rights not expressly granted are reserved.

8. Your Grant of License to Feedback and Submissions

We welcome your feedback and suggestions for improving the Site and our services. However, by submitting feedback, testimonials, comments, or any other information or materials (collectively, “Submissions”), you agree to the following:

  • You have the legal right to submit the material;

  • Your Submissions do not infringe any intellectual property or privacy rights of any third party;

  • Your Submissions are accurate, lawful, and voluntarily provided.

Subject to our Privacy Policy, by submitting any Submissions to The Mason Projects, you grant us an irrevocable, perpetual, worldwide, royalty-free, transferable, assignable, sublicensable, fully paid-up, non-exclusive license to use the Submissions in any format or medium now known or developed in the future. This includes, but is not limited to, the rights to reproduce, publish, display, create derivative works, commercialize, distribute, analyze, or otherwise use the materials for any lawful purpose without notice, attribution, or compensation to you.

This license extends to any ideas, concepts, feedback, or information you provide related to the Site, Search Requests, Investigative Reports, or our services. You acknowledge that The Mason Projects does not solicit such materials and that you assume all responsibility and risk for anything you voluntarily submit.

9. Posting Reviews, Social Media Forums, Rights to Use and Use at Your Own Risk

You acknowledge and agree that You have no proprietary interest in the contents of the Site or any affiliated websites whatsoever, including, without limitation, any social media pages or forums that We control, such as blogs, message boards, comment areas and other interactive features and functionality where users may post certain comments and other content. Moreover, by submitting Your feedback, suggestions, commentary, review(s) and/or forum contributions, You grant Us a royalty-free, irrevocable, non-exclusive, assignable, transferable and sublicensable right and license to use, reproduce, modify, publish, translate, create derivative works from, distribute, transmit, perform and display such content or information (in whole or in part) contained in the review or forum for any purpose and/or to incorporate into other works in any form, media or technology now known or later developed for the full term of any rights that may exist in such content or information. You hereby represent that You have all necessary rights to make Your review and/or forum contributions available to Us and to the Site and You also acknowledge and agree that such reviews and/or forum contributions are non-confidential for all purposes and that We have no control over the extent to which any idea or information therein may be used by any party once such content is posted or displayed. You hereby acknowledge and agree that We assume no responsibility for, and recommend that You do not post, display or transmit, any confidential or sensitive information. All users shall remain solely and exclusively responsible for any liability arising from their own reviews and forum contributions.

To the extent You wish to post honest reviews and commentary of the Site, Investigative Reports and any corresponding services or items, and/or any forum contributions, You hereby acknowledge and agree to the following:

    • Anything that could reasonably interfere with or disrupt the operation of the Site and/or affiliated websites;

    • Unauthorized copyrighted materials or any other content that infringes on the intellectual property, privacy and/or publicity rights of others;

You acknowledge and agree that We reserve the right, in Our sole discretion, to not post or to remove any posted review and/or forum contribution for any reason and without notice or notification. Similarly, We neither endorse nor assume any liability for the contents of any material uploaded or submitted by third party users of the Site. We generally do not pre-screen, monitor, or edit the content posted by users of communications services, chat rooms, message boards, newsgroups, software libraries, or other interactive services that may be available on or through this Site. However, we and our agents have the right at their sole discretion to remove any content that, in our judgment, does not comply with these Terms and any other rules of user conduct for our site, or is otherwise harmful, objectionable, or inaccurate. We are not responsible for any failure or delay in removing such content. You hereby consent to such removal and waive any claim against us arising out of such removal of content.

10. Fees, Taxes and Billing

If You wish to use the Site's services or otherwise purchase any product or service through the Site, You will be presented with the applicable fees and billing arrangement prior to Your purchase, which may include recurring charges. By placing an order, You authorize Us to charge Your selected payment method accordingly.

We may request additional authentication for Your payment method. If You believe Your payment method was used fraudulently, please contact us immediately through our contact form at FBIJane.com/contact. We do not accept payment by check, cash, or money order.

All purchases may be subject to applicable sales or use taxes depending on Your jurisdiction. You agree to pay all such taxes or allow us to collect and remit them on Your behalf.

If You fail to make timely payments, We may assess interest and suspend or terminate Your access.

We also reserve the right to refuse or cancel any order suspected of fraud or misuse. If We cancel an order after charging Your payment method, We will issue a refund where appropriate. For questions, contact us at FBIJane.com/contact.

11. Indemnification

You agree to indemnify, defend and hold harmless The Mason Projects LLC and its brands—including FBI Jane and Janexfbi—as well as Our affiliates, directors, officers, employees, agents, licensors, and service providers, from and against all third-party claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the Site, Investigative Reports, or any other services or materials We provide;

  • Your violation of these Terms;

  • Any unlawful or unauthorized use of the Site by You; or

  • Any claims by a Search Subject or third party relating to Your submission of personal information or content.

These obligations survive any termination of Your use of the Site or services. We reserve the right to assume exclusive control of any matter subject to indemnification by You and You agree to cooperate with Us in such event.

You assume all risks related to the use of the Site and any services or materials provided. We do not warrant or guarantee the reliability, completeness, legality, or accuracy of any Investigative Report, third-party data, or any content available through the Site.

We expressly disclaim any responsibility for “false positives,” where information may mistakenly refer to individuals or entities not intended due to similar names or data discrepancies. You acknowledge and accept that any data We deliver may not perfectly match the subject of Your request, and You should not rely on any Investigative Report or related output as a sole basis for decisions without conducting additional due diligence.

We reserve the right to modify, discontinue, or remove any content, services, or features of the Site at any time without notice. No verbal or written advice obtained from Us or any third party shall create any warranty not expressly stated in these Terms.

13. Limitation of Liability

YOU EXPRESSLY UNDERSTAND AND AGREE THAT THE MASON PROJECTS LLC, INCLUDING ITS BRANDS FBI JANE AND JANEXFBI, TOGETHER WITH ITS PARENTS, SUBSIDIARIES, AFFILIATES, JOINT VENTURES, AND THIRD-PARTY SERVICE PROVIDERS, AND EACH OF THEIR RESPECTIVE MEMBERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SHAREHOLDERS, CO-BRANDERS, CONTENT LICENSORS, SUPPLIERS, CONTRACTORS, ATTORNEYS AND OTHER PARTNERS, SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES—TO THE FULLEST EXTENT PERMITTED BY LAW—INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), ARISING FROM OR RELATED TO:

  • (a) YOUR USE OF, OR INABILITY TO USE, THE SITE, ANY INFORMATION CONTAINED THEREIN, OUR CONTENT, INVESTIGATIVE REPORTS, OR ANY OTHER PRODUCTS OR SERVICES WE OFFER;

  • (b) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES RESULTING FROM YOUR PURCHASE OF, OR ACCESS TO, ANY PRODUCTS, SERVICES, CONTENT, OR DATA THROUGH THE SITE;

  • (c) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR REGISTRATION DATA OR OTHER INFORMATION MAINTAINED BY US;

  • (d) ANY OTHER CLAIM OR DISPUTE RELATING IN ANY WAY TO THE SITE, CONTENT, INVESTIGATIVE REPORTS, OR OTHER PRODUCTS OR SERVICES.

THIS LIMITATION APPLIES TO ALL LEGAL THEORIES AND CAUSES OF ACTION—INCLUDING, BUT NOT LIMITED TO, BREACH OF CONTRACT, BREACH of WARRANTY, NEGLIGENCE, STRICT LIABILITY, MISREPRESENTATION, AND OTHER TORTS. YOU HEREBY RELEASE THE MASON PROJECTS LLC, ITS BRANDS, AND THEIR AFFILIATED PARTIES FROM ANY AND ALL OBLIGATIONS, LIABILITIES, AND CLAIMS IN EXCESS OF THESE LIMITATIONS.

IF APPLICABLE LAW DOES NOT ALLOW CERTAIN EXCLUSIONS OR LIMITATIONS, THEN OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUT IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED FIVE HUNDRED DOLLARS ($500.00).

NO CLAIM OR ACTION, REGARDLESS OF FORM, ARISING FROM YOUR USE OF THE SITE, OUR CONTENT, INVESTIGATIVE REPORTS, OR OTHER SERVICES, MAY BE BROUGHT BY EITHER PARTY MORE THAN ONE (1) YEAR AFTER THE CAUSE OF ACTION AROSE.

THE LIMITATIONS IN THIS SECTION ARE A FUNDAMENTAL BASIS OF THE AGREEMENT BETWEEN YOU AND US. ACCESS TO THE SITE AND SERVICES WOULD NOT BE PROVIDED WITHOUT SUCH LIMITATIONS.

16. Links to Other Websites, Advertisers, Third-Party Products/Services – All at Your Own Risk

For Your convenience in locating or accessing related information, products, or services, the Site may provide links to third-party websites or references to third-party content, services, software, or materials. These third-party sites and providers are not controlled by Us, and We are not responsible for their content, functionality, practices, or offerings.

We do not endorse, sponsor, or verify any third-party websites, services, or products, and the inclusion of a link or reference does not constitute Our endorsement or affiliation. These links and references are provided solely as a convenience. You understand and agree that by accessing these third-party websites or services, You do so at Your own risk.

Some linked websites may display Our name, logo, or branding under co-branded arrangements, but We do not control the content, policies, or availability of those sites. Any materials or services provided by such third parties are subject to their own terms and policies, not Ours.

  • The accuracy, completeness, quality, legality, or reliability of content on third-party websites;

  • The safety, availability, or performance of products, services, or promotions offered by third parties;

  • Any errors, omissions, offensive content, or broken links present on such sites;

  • Any actions or transactions You engage in with third-party advertisers, vendors, or service providers.

If You choose to interact with third-party advertisers, click on third-party links, or participate in promotions offered by third parties through the Site, any agreements, warranties, representations, or other dealings are strictly between You and the applicable third party. We are not liable for any loss, damage, or issues arising out of such interactions or transactions.

We make no representations or warranties regarding the suitability, legality, non-infringement, timeliness, or completeness of any content, products, services, or materials provided by or accessed through third-party websites. All risk rests with You.

17. Refund Policy

This includes, but is not limited to:

  • Digital downloads

  • Templates

  • Reports

  • Consultations

  • Access to restricted content or member areas

18. Treatment of Reversals and Chargebacks

As with other reputable online merchants, intentional credit or debit card reversals and chargebacks are often indicators of potential fraud, misuse, or theft of services. We reserve the right to treat such actions as fraudulent activity.

We may investigate any chargeback or reversal and, where appropriate, report the matter to relevant local, state, or federal law enforcement authorities. Please be advised that We regularly monitor all internet protocol (IP) address information and user activity associated with Site access and purchases. This information may be used in a civil and/or criminal case against any customer, especially in instances involving suspected fraud, abuse, or theft of services.

We take these matters seriously and will pursue all available legal remedies to protect our business, products, and community.

19. Equitable Relief

You agree that any breach or threatened breach of these Terms or any unauthorized or unlawful use of the Site or any Investigative Services or Reports would result in irreparable injury to The Mason Projects for which monetary damages would be inadequate. In such event, The Mason Projects shall have the right, in addition to other remedies available to it at law and in equity, to immediate injunctive relief without the need to post a bond. Nothing contained in these Terms shall be construed to limit any legal or equitable remedies available to The Mason Projects.

20. Entire Agreement

These Terms, the Privacy Policy, and all other applicable operating rules, policies, price schedules, and other supplemental terms and conditions or documents that may be published or agreed upon by You from time to time, which are expressly incorporated herein by reference, constitute the entire and only agreement between You and The Mason Projects with respect to Your use of the Site, services, and all related content. These Terms supersede all prior or contemporaneous agreements, representations, warranties, and understandings with respect to the Site or services.

To the extent that any information or material that appears on or is posted to the Site—or otherwise made available by Us—contains any representation, term, or condition that is in conflict or inconsistent with these Terms, these Terms shall take precedence unless revised terms or conditions are set forth in a signed writing by one of Our duly authorized officers.

21. Force Majeure

Other than for payment obligations, neither party shall be liable for, or be considered in breach of, these Terms due to any delay or failure to perform as required hereunder as a result of causes or conditions that:
(a) are beyond the party’s reasonable control (including, but not limited to, acts of G-d, storms and other natural disasters, fires, explosions, telecommunications or internet outages, network failures, acts of vandalism or computer hacking, national emergencies, insurrections, acts of terrorism, riots, wars, strikes, or other comparable labor disturbances); and
(b) the party is unable to overcome through the exercise of commercially reasonable diligence
(collectively, a “Force Majeure Event”).

If a Force Majeure Event occurs, the affected party shall notify the other party and shall use commercially reasonable efforts to minimize the impact and duration of the event.

22. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be modified and interpreted to best accomplish its intended objectives to the fullest extent permitted by law. All remaining provisions shall continue in full force and effect.

23. Waiver

The Mason Projects LLC’s failure to enforce any specific right or remedy for any breach of, or insist upon strict adherence to, any provision of these Terms shall not operate as or be construed to be a waiver of its right to enforce such remedies for breaches of, or to insist upon strict adherence to, that provision or any other provision of these Terms. Any waiver of a provision of these Terms must be set forth in a signed writing by a duly appointed officer of The Mason Projects LLC.
